Buying property in Jamaica is a major investment, and whether you are a local buyer or an overseas investor, understanding the legal process is essential to protect your interests. Working with a real estate lawyer in Jamaica ensures your transaction is secure, compliant, and free from costly mistakes.
The process begins with your lawyer conducting due diligence on both the vendor and the property, this includes a title search at the National Land Agency to confirm ownership and the identification of any encumbrances such as mortgages or caveats registered on the land. the next step is negotiating and signing an Agreement for Sale. A deposit—typically 10% of the purchase price—is paid by the purchaser on signing and held in escrow by the vendor’s attorney until the sale is completed.
Once the Agreement is signed, the purchaser typically has 90-days to provide the Vendor with the balance of the purchase price. during this time, the parties should execute an Instrument of transfer to be held by the Vendor's attorney. once the balance of the purchase price is paid or the Vendor's attorney receives an acceptable letter of undertaking from a financial institution, then the Purchaser and vendor should pay transfer tax and stamp duty in accordance with the terms of the Agreement for Sale. The Instrument of Transfer is then lodged for registration with National Land Agency (NLA) along with the Vendor's original Title for the Property. The NLA will also charge a registration fee for the registration of the Transfer on the Certificate of Title of the property. Upon completion, ownership is legally transferred and the Certificate of Title that reflects the registration of the transfer will be Issued by the NLA.
